REVEREND DELONG: Let us
pray. Holy and compassionate God, creator and lover of every living
creature, spirit beneath and beyond the vast star nations of the universe,
this day we give thanks for all that keeps life civil and sacred and
human. For the rule of law, for the principles of justice and
all who are committed to them. For everything that has taught
us to affirm the sacredness of all persons, regardless of rank or station,
class or color. We ask Your blessing this day on our nation and
on our beloved state. We pray for our President, George, and for
our Governor, Angus. We pray for our Senators gathered here today.
We give thanks for all the people in their lives; parents, teachers,
family, mentors who nudged them towards the vocation, the high calling
of public service. May each of them be humble enough to listen
well and brave enough to lead with courage and conviction. Grant
this Senate a grand vision of the possibilities of politics. And
if there is any bias in this place, may it be towards the hungry and
the homeless, the abused and the vulnerable. If there is any place
where we give a clear voice to the voiceless, may it be here.
For all the blessings and abundance of our lives we give thanks.
Make us good and faithful stewards of all that we have been entrusted.

ORDERED,
the Senate concurring, that the Joint Select Committee to Study the
Necessity for Legislation Requiring Public Access to Rest Rooms by Service
Stations Owned by Large, Out-of-state Companies is established as follows.
1.
Joint Select Committee to Study the Necessity for Legislation Requiring
Public Access to Rest Rooms by Service Stations Owned by Large, Out-of-state
Companies established. The Joint Select Committee to Study the
Necessity for Legislation Requiring Public Access to Rest Rooms by Service
Stations Owned by Large, Out-of-state Companies, referred to in this
order as the "committee," is established.
2. Membership. The committee
consists of the following 3 members:
A.
One member of the Senate, appointed by the President of the Senate;
and
B.
Two members of the House, appointed by the Speaker of the House.
3.
Appointments; chairs; convening of committee. All appointments
must be made by August 1, 2001. The appointing authorities shall
notify the Executive Director of the Legislative Council once all appointments
have been made. The Senate member is the Senate chair and the
first named House of Representatives member is the House chair.
The first meeting must be called by the chairs no later than September
1, 2001. The committee may meet up to 4 times to carry out its
duties.
4.
Duties. The committee shall study the policies of service stations
as they pertain to public rest rooms and the need for requiring that
service stations owned by large, out-of-state companies provide public
rest rooms.
5.
Staff assistance. Upon approval of the Legislative Council, the
Office of Policy and Legal Analysis shall provide necessary staffing
services to the committee.
6.
Compensation. Members of the committee are entitled to receive
the legislative per diem as defined in the Maine Revised Statutes, Title
3, section 2 and reimbursement for travel and other necessary expenses
for attendance at authorized meetings of the committee.
7.
Report. The committee shall submit a report on the issues studied
along with any recommended legislation to the Legislature no later than
November 1, 2001. If the committee requires an extension of time
to make its report, it may apply to the Legislative Council, which may
grant the extension.
8.
Committee budget. The chairs of the committee, with assistance
from the committee staff, shall administer the committee's budget.
Within 10 days after its first meeting, the committee shall present
a work plan and proposed budget to the Legislative Council for its approval.

ORDERED,
the Senate concurring, that the Task Force to Study the Costs and Design
of a Household Hazardous Waste Disposal Program is established as follows:
1.
Task force established. The Task Force to Study the Costs and
Design of a Household Hazardous Waste Disposal Program, referred to
in this order as the "task force," is established.
2.
Task force membership. The task force consists of 13 members appointed
as follows:
A. The President of the Senate
shall appoint 3 members from the Senate: 2 who serve on the Joint Standing
Committee on Natural Resources and one who serves on the Joint Standing
Committee on Appropriations and Financial Affairs. The first named
Senate member is the Senate chair.
B. The Speaker of the House of
Representatives shall appoint 10 members from the House of Representatives:
5 who serve on the Joint Standing Committee on Natural Resources and
5 who serve on the Joint Standing Committee on Appropriations and Financial
Affairs. The first named House member is the House chair.
3.
Appointments; convening task force. All appointments must be made
no later than 30 days following the effective date of this order.
The appointing authorities shall notify the Executive Director of the
Legislative Council upon making their appointments. When the appointment
of all members is complete, the chairs of the task force shall call
and convene the first meeting of the task force no later than 60 days
following the effective date of this order.
4.
Duties. The task force shall study the costs and design of a household
hazardous waste disposal program.
5.
Meetings. In conducting its duties, the task force may meet as
often as necessary with any individuals, departments or institutions
it considers appropriate.
6.
Staff assistance. The task force may request staffing and clerical
assistance from the Legislative Council.
7.
Reimbursement. Members of the task force are entitled to receive
the legislative per diem, as defined in the Maine Revised Statutes,
Title 3, section 2, and reimbursement for travel and other necessary
expenses for attendance at meetings of the task force.
8.
Report. The task force shall submit its report along with any
recommended legislation to the Joint Standing Committee on Natural Resources
and the Joint Standing Committee on Appropriations and Financial Affairs
by November 15, 2001. Following receipt of the report, the Joint
Standing Committee on Natural Resources and the Joint Standing Committee
on Appropriations and Financial Affairs may introduce legislation to
the Second Regular Session of the 120th Legislature. If the task
force requires an extension of time to file its report, it may apply
to the Legislative Council, which may grant the extension.

TO FULFILL THE ORIGINAL INTENT TO FUND 40% OF THE COSTS OF SPECIAL EDUCATION
MANDATES TO THE STATES UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION
ACT
WE,
your Memorialists, the Members of the One Hundred and Twentieth Legislature
of the State of Maine now assembled in the First Regular Session, most
respectfully present and petition the President of the United States
and the Congress of the United States, as follows:
WHEREAS,
the Congress of the United States has found that all children deserve
a quality education, including children with disabilities; and
WHEREAS,
the Individuals with Disabilities Education Act, 20 United States Code,
Section 1400, et seq., provides that the Federal Government and the
state and local governments are to share in the expense of education
for children with disabilities and commits the Federal Government to
provide funds to assist with the excess of expenses of education for
children with disabilities; and
WHEREAS,
the Congress of the United States has committed to contribute up to
40% of the average per pupil expenditure of educating children with
disabilities, the Federal Government has failed to meet this commitment
to assist the states; and
WHEREAS,
the Federal Government has never contributed more than 12.6% of the
national average per pupil expenditure to assist with the excess expenses
of educating children with disabilities under the Individuals with Disabilities
Education Act; and
WHEREAS,
this failure of the Federal Government to meet its commitment to assist
with the excess expenses of educating a child with a disability contradicts
the goal of ensuring that children with disabilities receive a quality
education; and
WHEREAS,
the federal grant funds in the State for children zero to 2 years of
age represent only 30% of the cost of serving eligible infants and toddlers
in the State, and if the federal grants were at the 40% level, the award
to the State this year would have increased by $582,000; and
WHEREAS,
the federal grant funds in the State for children 3 to 5 years of age
represent only 8% of the cost of serving children 3 to 5 years of age
in the State, and if the federal grants were at the 40% level, the award
to the State this year would have increased by $10,086,000; and
WHEREAS,
the federal grant funds in the State for children 5 to 20 years of age
represent only 9.75% of the State's total special education expenditures
of $225,130,000, and if the federal grants were at the 40% level, the
award to the State this year would have increased by more than $68,000,000;
now, therefore, be it
RESOLVED:
That We, your Memorialists, respectfully urge and request that the President
of the United States and the Congress of the United States provide 40%
of the national average per pupil expenditure to assist states and local
education agencies with the excess costs of educating children with
disabilities; and be it further
RESOLVED:
That suitable copies of this resolution, duly authenticated by the Secretary
of State, be transmitted to President of the United States, to the President
of the Senate of the United States, to the Speaker of the House of Representatives
of the United States and to each Member of the Maine Congressional Delegation.
